Not exactly. I said
"while there are certainly legal means to download songs in mp3 format, much of this is piracy". Of course there are legal ways to download music. But I consider it likely that the overwhelming majority of music that is moved via mp3 format is not legal. If someone is saying what amounts to "I downloaded a very large volume of songs that would cost me thousands of dollars to do legally", law enforcement might still consider that reasonable suspicion to launch an investigation. I hope I'm wrong.

I'm by no means an expert on this topic, but my understanding is that you don't need to sell it to be convicted to stealing copyrighted material.
